The Court ordered The Garden City Group, Inc. to proceed with an initial distribution from the Engle Trust Fund. Checks in the amount of $9,000 were mailed to claims that have been deemed valid and complete by The Garden City Group, Inc.
Will there be another distribution?
The Court previously ordered that distribution by The Garden City Group, Inc. shall be equally made on a per injured smoker basis. In other words, the payment will be the same to each eligible claimant. Because the number of eligible claimants is not yet known, the final amount that each eligible claimant will receive is not yet known. The Court and the Trustee have determined that payments of $9,000 can be made to eligible claimants at this time. It is anticipated, but not guaranteed, that there will be an additional supplemental distribution. The supplemental distribution will be made after all claims have been resolved.
Yes – as additional claims are deemed valid and complete, The Garden City Group, Inc. will issue initial $9,000 distributions to these additional claims. These checks will be issued every two weeks.
We are not authorized to extend the deadlines printed on the Notices of Opportunity to Cure. However, the Court’s recent Order Regarding Distribution and Modification of Scheduling Order provides that if you obtain additional information that will complete your claim, you will have the opportunity to submit it on or before November 17, 2008.
What are the tax consequences of distributions from the Engle Trust Fund?
Please note that the tax treatment of this distribution varies based upon the individual circumstances and tax status of each Claimant. Accordingly, the Trustee and the Claims Administrator are not able to determine the appropriate tax reporting for any Claimant. Please consult with your tax advisor to determine the tax consequences, if any, that the distribution of the Engle Trust Fund may have to you.
